ABSTRACT
In the Netherlands, the application of the AAUPL principle is influenced by the concept
of a welfare state that places government officials as the party responsible for achieving
the general welfare of citizens. To make this happen, the Government is authorized to
intervene in all matters relating to people’s lives. This authority does not only come from
the law but in certain circumstances, the Government can use free authority (discretion)
or wisdom. However, sometimes violations are still committed by the Government in
carrying out the rule of law. Moreover, if the authority is based on its initiative. This has
caused concern among the community because of the potential for conflicts of interest
between the government and the community. AAUPL has two functions. First, as a tool for
judges to examine or assess the validity of administrative actions when legal provisions,
the applicable decision is not clear enough to provide regulation. Second, as a means of
control to prevent administrative actions that can cause arbitrariness towards the people.
